In purchasing Intelligent Mailer, you are indicating that you have read and fully understand this agreement and agree to be bound by the terms and conditions detailed below. If you do not agree with these terms and conditions then you must not purchase the Intelligent Mailer software.. ANY ONE FOUND IN BREACH OF THESE TERMS AND CONDITIONS WILL HAVE THEIR LICENSE REVOKED. NO NOTICE WILL BE GIVEN.

1. Your Responsibility

a) You must not use Intelligent Mailer for criminal purposes
b) Intelligent Mailer must not be used for anything offensive, obscene, defamatory, libelous, pirated, racist or anything which breaks copyright or trademark law.
c) You must not use Intelligent Mailer to obtain email addresses for the purpose of sending unsolicited emails to.
d) You must not use Intelligent Mailer to for the purpose of sending unsolicited emails.
e) You must ensure that the details which you use to purchase Intelligent Mailer are valid and up to date.

2. Our Responsibility

a) We will not be responsible for any losses resulting from your use or the inability to use our software or resulting from unauthorized access to, or alteration of your transmissions or data in circumstances which are beyond our control.
b) We will not be responsible for your loss of profits, wasted expenditure, corruption or destruction of data or any other loss however caused.

3. Backup of Data

a) The Data held on the database within the software is held solely at your own risk. You understand that you should regularly make your own backups of the data.

4. General

a) We endeavor to respond to complaints within 1 working days.
b) These terms are governed by the laws of England and Wales and any disputes will be decided only by the courts of England and Wales.
c) All errors and omissions are excepted.
d) If you are in breach of these terms and conditions you will not be refunded any monies you have paid.

5. Installation of software

a) We will install the software for you once free of charge, if you require us to reinstall the software at a later date then we will charge £50 per hour, as a guide we normally complete an installation within 30 minutes, all installations are subject to you making available the software requirements as shown on our web site http://www.intelligentmailer.com/requirements.html, we can not complete an install if these requirements are not met, the free installation offer is available up to 3 months from time of purchase.

b) Free installation is for Linux/Unix based systems only, the free installation service is not offered for Windows servers nor is installation support provided for Windows servers.

6 . Cancellation of order and refunds

a) If the license key hasn't yet been issued by us a full refund will be offered if the request is received in writing by us within 7 days of the purchase date, once the license key has been issued or after the 7th day no refund will be provided.

b) For our leased options 30 days written notice is required to cancel the service, as the minimum contract we offer is 3 months, cancellation can only be accepted at the end of the 2nd month. cancellation will only be accepted once all outstanding invoices are paid.

7 . Disclaimer of Warranty

a) THE Intelligent Mailer SOFTWARE IS PROVIDED "AS IS" AND WITHOUT WARRANTIES AS TO PERFORMANCE OR MERCHANTABILITY OR ANY OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED.
b) In particular, KT8 Marketing Ltd cannot be held liable for loss of information, loss of data or any other consequential loss which occurs by the use of our software. However KT8 Marketing Ltd will take such steps as is deemed reasonable (by KT8 Marketing Ltd) to ensure that such errors should not occur under normal use.

d) The software and any associated programs or scripts are owned by KT8 Marketing Ltd. The user is licensed to use these products.
e) The intellectual property of all software and scripts is owned by KT8 Marketing Ltd.
f) NO WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE IS OFFERED.
